PLEASE READ COMPLETELY BEFORE COMPLETING YOUR ORDER AS COMPLETION OF YOUR ORDER CONSTITUTES AGREEMENT TO THESE TERMS AND CONDITIONS.

 

THE SALE OF PRODUCTS AND SERVICES ("PRODUCTS") BY SIE POWER, L.L.C. AND ITS DIVISIONS AND SUBSIDIARIES ("SIE POWER") ARE SUBJECT TO THESE TERMS AND CONDITIONS (“AGREEMENT”) REGARDLESS OF OTHER OR ADDITIONAL TERMS OR CONDITIONS THAT CONFLICT OR CONTRADICT WITH THIS AGREEMENT IN ANY PURCHASE ORDER, DOCUMENT, OR OTHER COMMUNICATION ("ORDER"). PREPRINTED TERMS AND CONDITIONS ON ANY CUSTOMER (“CUSTOMER”) DOCUMENT (FOR EXAMPLE: PURCHASE ORDERS OR CONFIRMATIONS) AND/OR SIE Power'S FAILURE TO OBJECT TO CONFLICTING OR ADDITIONAL TERMS WILL NOT CHANGE OR ADD TO THE TERMS OF THIS AGREEMENT.

 

 

LIMITATION OF LIABILITY

The CUSTOMER is aware that performance PRODUCTS may exceed the design limits of the vehicle and its sub-systems.  Performance PRODUCTS by their nature are designed to increase horsepower and performance not engineered into the original vehicle and the increased stress could result in damage to related systems.  The PRODUCTS may cause the vehicle on which they are installed or used to become more powerful, be capable of higher speeds or otherwise alter its performance and handling characteristics. Suitability and implementation of parts is at the sole discretion of the CUSTOMER.  The CUSTOMER assumes all associated risks. 

 

The CUSTOMER is responsible to obey all applicable federal, state, and local laws, statutes, and ordinances when operating his/her vehicle, and the CUSTOMER agrees to hold SIE POWER harmless from any violation thereof.  Many PRODUCTS sold by SIE POWER are for off-road use only. SIE POWER cannot and will not guarantee the legality of any PRODUCTS since laws and regulations regarding the use of all PRODUCTS sold or installed by SIE POWER vary from state to state. It is up to the CUSTOMER or end user to determine the legality of PRODUCTS for the state(s) in which the car is registered and driven on public roads and the CUSTOMER or end user assumes all liability regarding the legality of all parts on the vehicle. Failure to comply with local and federal safety and emissions standards is the full responsibility of the CUSTOMER or end user. In the event such parts prove defective following their purchase and installation, the CUSTOMER, and not SIE POWER assumes the entire cost of any necessary servicing, repair or replacement.  SIE POWER assumes no responsibility for negligence, misuse, or illegal action by the CUSTOMER or end user. SIE POWER highly recommends professional installation by a competent mechanic for all PRODUCTS purchased.  SIE POWER assumes no liability regarding the improper installation or misapplication of its PRODUCTS. It is the installer's responsibility to check for proper installation and if in doubt, contact the manufacturer.

 

SIE POWER is not liable for and the CUSTOMER is not entitled to any indirect, special, incidental or consequential damages; for example, loss of profits or revenue, loss of data, loss of use, rework, manufacturing expense, injury to reputation, or loss of CUSTOMERS.  The CUSTOMER'S recovery from SIE POWER for any direct damages will not exceed the price of the PRODUCT at issue.  The CUSTOMER will indemnify, defend and old SIE POWER harmless from any claims based on; (i) SIE POWER'S compliance with the CUSTOMER'S designs, specifications, or instructions, (ii) modification of any PRODUCTS by anyone other than SIE POWER, or (iii) use in combination with other PRODUCTS.

 

SIE POWER disclaims any warranty and expressly disclaims any liability for personal injury or damages.  The CUSTOMER acknowledges and agrees that the disclaimer of any liability for personal injury is a material term for this agreement and the CUSTOMER agrees to indemnify SIE POWER and to hold SIE POWER harmless from any claim related to the PRODUCTS purchased.   SIE POWER is also not responsible for any labor, transportation costs or any other charges incurred in the replacement or repair of any car using SIE POWER PRODUCTS.  Furthermore, PRODUCTS are not authorized for use in critical safety or other applications where a failure may reasonably be expected to result in personal injury, loss of life, or catastrophic property damage.  If CUSTOMER uses or sells the PRODUCTS for use in any such applications, CUSTOMER acknowledges that such use or sale is at CUSTOMER'S sole risk. CUSTOMER will indemnify, defend and hold SIE POWER and the manufacturer harmless from and against any and all liabilities and costs arising out of or in connection with such use or sale.  Under no circumstances will SIE POWER be liable for any damages or expenses by reason of use or sale of any such PRODUCTS. 

 

The CUSTOMER is responsible to fully understand the capability and limitations of his/her vehicle according to manufacturer specifications and agrees to hold SIE POWER harmless from any damage resulting from failure to adhere to such specifications.  The CUSTOMER or end user agrees to operate the vehicle under the conditions set forth in this agreement and agrees to hold SIE POWER, its employees, officers and vendors harmless by reason of any claim, damages, accident or injuries resulting from the installation of the parts or the use of the vehicle with the installed parts.

 

SIE POWER is not accountable for any misconception or disappointments associated with any sold PRODUCTS.

 

WARRANTY AND DISCLAIMER

SIE POWER offers a 90 day limited warranty against defects in workmanship or materials on PRODUCTS manufactured by SIE POWER.  PRODUCTS branded as SIE POWER may be made up of components provided by other manufactures.  SIE POWER will transfer to CUSTOMER any PRODUCT warranties and indemnities authorized by the manufacturer, including any transferable warranties and indemnities for intellectual property infringement.  SIE POWER provides a limited warranty on these PRODUCTS as part of its package.  Limited warranty details are provided on a per PRODUCT basis. CUSTOMER acknowledges that there may be additional conditions of sale as set forth in the PRODUCT sales literature of the respective manufacturers of PRODUCTS sold by SIE POWER.  SIE POWER MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED.  SIE POWER MAKES NO WARRANTY OF MERCHANTABILITY, FITNESS FOR PURPOSE OR NON-INFRINGEMENT. If PRODUCTS do not meet manufacturer's specifications or if value-added work by SIE POWER does not meet CUSTOMER'S specifications the PRODUCTS will be, at SIE POWER'S choice: (1) repaired, (2) replaced at no cost to CUSTOMER; or (3) refunded in the amount of the CUSTOMER'S purchase price.  CUSTOMER must return PRODUCTS to SIE POWER, along with acceptable proof of purchase, within the warranty period specified by SIE POWER and/or the manufacturer.  SIE POWER or the PRODUCT manufacturer shall inspect and/or test all PRODUCTS prior to any decision.   Simply returning the PRODUCT to SIE POWER  will not guarantee payment of a warranty claim.   Any cancellation of payment or reversal of charges by CUSTOMER prior to decision will result in penalties and fees to the CUSTOMER.  SIE POWER  shall not pay for consequential, incidental and/or contingent damages or costs incurred of any kind, including the cost incurred directly or indirectly in relation to PRODUCTS sold by SIE POWER.  

 

LIMITED WARRANTY

No warranty is provided for PRODUCT that is "free" or that was received by the CUSTOMER at no charge from SIE POWER.  No warranty is provided on electrical components (i.e. air sensors, oxygen sensors, light bulbs, etc.) or wearable mechanical item (i.e. brake rotors, brake pads, clutch discs, clutch pressure plates, flywheels, etc).   This warranty does not cover housings, perches, seized perches, broken shock absorber adjusters, accident damage, or damage from improper use or installation, removed bump stops, removed helper springs, excessive lowering, or non-professional installation.  Non-transferable.

TURBO CHARGERS:  In order to qualify for warranty coverage on turbo chargers, the CUSTOMER must provide proof that the following was done at the time of install:  oil change, oil feed and return line replacement, new paper or cleaned reusable air filter, spark plugs, all new gaskets and install hardware for turbo, along with a minimum break in of 750 miles low RPM / load and low boost.

ECU UPGRADES, EPROM, SOFTWARE, TUNING:  Due to the large number of variables with regards to upgrading the ECU programming on a vehicle, especially as pertaining to the current level of service and maintenance, condition and usage of the vehicle, as well as possible extraneous damage due to circumstances beyond our control including fuel quality, octane, installer error or user abuse, the CUSTOMER assumes any and all responsibility for any and all damages associated with ECU modifications and any related parts or services.  SIE POWER is not liable for any PRODUCT cost, labor fee, towing, or any other fees or costs related to the installation of performance software on a vehicle.   Installation of performance software can result in lack of warranty coverage / voiding of warranty, as it pertains to the original issuer of said warranty, and SIE POWER makes no claims or guarantees with regards to warranty coverage.

 

ORDERING INFORMATION

Due to fabrication methods, PRODUCT photos do not always reflect the exact PRODUCT being sold.  All prices, part numbers, specifications, terms and conditions are subject to change without notice.  Updates will be made to web pages to reflect any changes as quickly as possible.

 

PRODUCT INFORMATION: PRODUCT information, including information related to a PRODUCT'S specifications, export/import control classifications, uses or conformance with legal or other requirements, is obtained by SIE POWER from its suppliers or other sources. Such information is provided by SIE POWER on an "AS IS" basis.  SIE POWER makes no representation as to the accuracy or completeness of the PRODUCT information, and DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND LIABILITIES UNDER ANY THEORY WITH RESPECT TO THE PRODUCT INFORMATION, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. SIE POWER recommends CUSTOMER validate any PRODUCT information before using or acting on such information. All PRODUCT information is subject to change without notice.  SIE POWER is not responsible for typographical or other errors or omissions in PRODUCT information and reserves the right to correct any errors before, after or during the time period that an order is placed.  SIE POWER shall not be responsible for information provided by third parties (i.e. PRODUCT specifications, delivery dates, etc). 

 

PRICES: Quoted prices are estimates only and are valid for 30 days or as otherwise stated in the quote.  Prices and availability are subject to change at any time and without notice.  Prices are for PRODUCTS only and do not include taxes, impositions and any other charges, fees, shipping charges and duties imposed by any government authority.  CUSTOMER is responsible for any additional fees and taxes, inclusive of labor charges that may or may not be included in quote.  SIE POWER cannot confirm the price of an item until after the item is ordered.  Items in the Shopping Cart are set to reflect the most recent price displayed on the item’s PRODUCT detail page.  Please note that this price may differ from the price shown for the item when the CUSTOMER first placed it in the Shopping Cart.  It is possible some items may be mispriced; all efforts are made to correct any mistakes as soon as is possible, however due to the huge range of PRODUCTS, constant change in pricing and industry standards, there may occasionally need to be changes made after an order is placed but before it is processed.  In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or PRODUCT information, SIE POWER shall have the right, at its sole discretion, to refuse or cancel any orders placed for that item.   In the event that an item is mispriced, SIE POWER may, at its sole discretion, either contact CUSTOMER for instructions or cancel CUSTOMER'S order and notify CUSTOMER of such cancellation.  

 

ORDERS: All ORDERS are subject to acceptance by SIE POWER.  SIE POWER reserves the right, at its sole discretion, to refuse or cancel any order for any reason.   Situations that may result in CUSTOMER'S order being cancelled include but are not limited to limitations on quantities available for purchase, inaccuracies or errors in PRODUCT or pricing information, or problems identified by our credit department.  SIE POWER  may also require additional verification or information before accepting any order.   SIE POWER reserves the right to allocate the sale of PRODUCTS among its CUSTOMERS. Orders for special, custom, value-added and PRODUCTS specifically identified by SIE POWER as non-standard are non-cancelable and nonreturnable (“NCNR”). The CUSTOMER may not cancel or reschedule ORDERS for standard PRODUCTS without SIE POWER'S consent, which shall not be unreasonably withheld.  Any cancellation of payment or reversal of charges by CUSTOMER prior to consent will result in penalties and fees to the CUSTOMER as deemed appropriate by SIE POWER.  In some cases, the CUSTOMER may need to be contacted by phone before an order will be processed.  In the event there are any questions that must be answered, a phone conversation will insure that the order is made correctly and to the CUSTOMER'S specifications.  SIE POWER'S contact number is (970) 493-0459 and normal business hours are Monday through Friday 10:00 AM to 4:00 PM CST.

 

SPECIAL ORDERS: All special orders, like all in-stock orders, require the full payment upon ordering.  SIE POWER will notify CUSTOMER during a phone order or contact CUSTOMER after a web order is made to clarify the item is special order and verify the CUSTOMER wants to wait for that particular item. Wait times on special order PRODUCTS can vary immensely, sometimes weeks, sometimes months and in some cases up to a year or more for backordered PRODUCTS.  If a cancellation occurs by the CUSTOMER for any reason during that wait time, the full payment is forfeited.  SIE POWER is not liable for late shipments.  Shipping dates are approximate. CUSTOMER shall not be entitled to chargebacks, reductions in price, and/or other offsets, as a result of a late shipment(s) or failure to deliver in the approximated delivery date or timeframe.  No exchanges, refunds, or store credit will be issued on any special order item, all sales are final.

 

BACKORDERS: Some items listed on the web pages may be on a backorder standing depending on current manufacturer availability and the fabrication timeline. If this is the case for an order which is placed, SIE POWER will contact the CUSTOMER for approval of backorder or with options on substitutions or cancellation of the order.  All sales are final and all PRODUCTS sold by SIE POWER are sold "as is" to the CUSTOMER.  All PRODUCTS remain the property of SIE POWER until payment is made in full, this includes during chargeback proceedings while the money has been removed from SIE POWER bank accounts.  Cancellations of orders are not permitted except with SIE POWER'S prior approval and will be subject to penalties and fees as deemed appropriate by SIE POWER.  All orders are not valid and will not be shipped until payment is made in full, with the exception of financed PRODUCTS as per the terms and conditions listed separately in this agreement.

 

TERMS OF PAYMENT: Payment of the total invoice amount, without offset or deduction, is due 30 days from the invoice date. On any past due invoice, SIE POWER may charge interest from the payment due date to the date of payment (at 1 ½ % per month), plus reasonable attorney fees and collection costs.  SIE POWER may change the terms of CUSTOMER'S credit at any time.  SIE POWER may apply payments to any of CUSTOMER'S accounts.

 

PAYMENT METHODS: Visa, Discover, Master Card and American Express as well as certified cashiers check or a money order are accepted for payment.  A valid daytime phone number as well as the final shipping destination address in full are required at the time of order.  If using a credit card, please have the credit card number, the expiration date and the three- or four-digit security code number from the back of the card ready when the ORDER is placed.   If paying with a check, orders are not processed for 21 days after receipt of check. There is a fee of $35.00 for any returned checks.

 

Important: By placing an order with SIE POWER, the CUSTOMER agrees to allow SIE POWER to charge the supplied credit card for the PRODUCTS requested.  Placing an order constitutes the CUSTOMER'S signature.   SIE POWER will not process or ship an order that has a different person’s name on the credit card than the CUSTOMER'S.  No exceptions.  These errors will cause delays in processing.  For any requested exceptions or for further information please call to place the order at 970-493-0459.

 

Processing: SIE POWER does NOT process your credit card automatically. For CUSTOMER security and to minimize fraudulent orders, SIE POWER manually approves and processes every order. All CUSTOMERS will be notified of a backorder situation before processing occurs. CUSTOMER is not to assume that SIE POWER has processed the charge; it is the CUSTOMER'S responsibility to properly manage their accounts and credit cards and SIE POWER cannot / will not be held liable for any overdraft fees, charges, or problems.

 

LEAD TIME: Most orders are usually processed within 5-15 days after order confirmation.  Special-order items may require significant additional time depending on the item or items being ordered; SIE POWER will discuss time frames with CUSTOMER at time of internal order processing and will notify CUSTOMER of any delays thereafter.

 

DELIVERY AND TITLE: CUSTOMER is responsible for all shipping costs and any applicable surcharges. Title and risk of loss pass to CUSTOMER upon delivery of the PRODUCTS to the carrier.  SIE POWER'S delivery dates are estimates only and SIE POWER is not liable for delays in delivery. SIE POWER reserves the right to make partial shipments and CUSTOMER will accept delivery and pay for the PRODUCTS delivered.  A delayed delivery of any part of an ORDER does not entitle CUSTOMER to cancel other deliveries.

 

SHIPPING INFORMATION

The usual method of shipping used by SIE POWER is Federal Express Ground Services.  Please note that the CUSTOMER must be available to sign for the FedEx shipment.  FedEx will make up to 3 delivery attempts; if the CUSTOMER is not available at any of those times, they will send the shipment back to SIE POWER.  If the shipment is returned to SIE POWER because the CUSTOMER was not available to sign for it, the CUSTOMER will be responsible for added shipping charges. Shipping charges for truck shipments are to be prepaid to SIE POWER before an order leaves the SIE POWER shipping facility.  The CUSTOMER is responsible for any and all applicable charges.  Shipping is a fee paid to the provider for their service and is therefore non refundable. Shipping quotes may not reflect actual cost.  Actual shipping will be charged on each order. The CUSTOMER will be notified of any discrepancy prior to charge. 

 

PUERTO RICO, ALASKA AND HAWAII: Orders must be prepaid by credit card or money order or cashiers check before leaving the SIE POWER shipping facility.

CANADA: Orders must be prepaid by credit card or U.S. bank money order. All payments are to be in US funds. Federal Express will service most cities in the provinces of Canada. Federal Express will act as your broker.  CUSTOMER is responsible for duty fees and taxes.  SIE POWER can also ship through the US postal system on some smaller items.

OTHER FOREIGN SHIPMENT: Orders must be pre-paid by credit card or money order.  Payments must be in US funds.  SIE POWER cannot ship directly to any destination outside the United States.  It is the CUSTOMER'S responsibility to secure a broker that SIE POWER can ship to in the United States. The broker can arrange to ship by air freight or ocean freight.  SIE POWER can provide the names of several brokers; THE CUSTOMER can decide which is the best to use for their situation.  The CUSTOMER will need to call for a shipping charge estimate. There is a $10.00 processing fee for all foreign orders.  All foreign-order sales are considered final.

 

RUSH OR EXPEDITED SHIPMENTS: Poor planning by the CUSTOMER does not constitute an emergency for SIE POWER.  All ORDERS are processed on a first-come, first-serve basis.  If rush or expedited shipping is requested by phone, SIE POWER will reasonably honor the request.  The CUSTOMER'S order will be processed and charged accordingly.  SIE POWER is not liable for delays in delivery due to causes beyond its reasonable control, inclusive of those caused by carrier.  

 

CONTINGENCIES: SIE POWER is not liable for failure to fulfill its obligations for any accepted ORDER or for delays in delivery due to causes beyond its reasonable control (for example: acts of God, acts or omissions of the CUSTOMER, man-made or natural disasters, epidemic medical crises, materials shortages, strikes, labor disputes, utility or communication failures, accidents, acts of terrorism, delays in transportation, inability to obtain labor or materials through its regular sources, or any act or cause does not normally occur in the ordinary course of sellers business). 

 

RETURNS AND EXCHANGES

SIE POWER wants all CUSTOMERS to be completely satisfied with everything purchased from SIE POWER.  If for any reason the CUSTOMER is not completely satisfied with a purchased PRODUCT, the CUSTOMER must call SIE POWER within 10 days of receipt of ORDER during regular business hours to discuss the problem. 

 

CUSTOMER cannot return PRODUCTS without a return material authorization ("RMA") number.  SIE POWER is in no way responsible for items sent in without following the proper return procedure.  RMAs will be issued only for damage, shortage, or other discrepancy to PRODUCTS created solely by SIE POWER or the original manufacturer, and only if CUSTOMER notifies SIE POWER in writing of any damage, shortage, or other discrepancy to PRODUCTS within 10 days after delivery. RMAs will not be granted for damage, shortage, or other discrepancy created by CUSTOMER, the carrier or freight provider, or any other third party. Returned PRODUCTS must be in original manufacturer's shipping cartons or equivalent.  All PRODUCTS must be complete and undamaged.  Disassembled, damaged, and custom PRODUCTS cannot be returned.  CUSTOMER must return all PRODUCTS, freight and insurance prepaid, as specified in the RMA and pay any restocking charges.  A minimum 20% restocking fee will be charged on all items that were sent correctly but are then not wanted by the CUSTOMER.  All returns must be accompanied by a copy of original sales receipt and a copy of the approved RMA form with RMA number.  Return shipping must be prepaid by the CUSTOMER.  CUSTOMERS will be responsible for all shipping charges relating to returns, exchanges and warranty coverage, with very few exceptions.  COD’S on return packages will not be accepted.  CUSTOMER should send PRODUCT back with UPS or Fedex, insured for the proper amount. USPS is not an acceptable shipper for returned items and may result in significant delays or the loss of PRODUCT and return. CUSTOMER should note the tracking number for any lost / damaged package claims. SIE POWER cannot cover or research any misplaced or lost / damaged packages which have either not been properly insured, or those without tracking numbers. If the package has been listed as delivered but the CUSTOMER has not been contacted or credited, the CUSTOMER should email info@SIE POWER2.net for a status update. CUSTOMER'S failure to call for return authorization before returning any item may result in no refund being issued.  Items shipped to SIE POWER without prior authorization will be refused and returned to the CUSTOMER at the CUSTOMER'S expense. When an approved return is received, it will be thoroughly inspected before any refund will be given. At SIE POWER'S discretion, SIE POWER will return all PRODUCTS not eligible for return to CUSTOMER, freight collect, or hold PRODUCT for CUSTOMER'S account at CUSTOMER'S expense.  Shipping is non-refundable.  If the CUSTOMER has any questions regarding returning any items, inquires should be made before ordering.

 

CANCELLED ORDERS: ONLY when the PRODUCT is out of stock, will SIE POWER cancel and process a refund  within 24-72 business hours of the CUSTOMER'S request.   The CUSTOMER'S bank can (and usually will) take at least 3-14 days to show the credit.  For ALL other cancelled orders a 5% cancellation fee applies without exception; this charge covers the costs incurred when SIE POWER and the CUSTOMER'S bank both process and return the payment(s).

 

REFUSED SHIPMENTS: CUSTOMERS will be charged a 25 % handling charge on all refused shipments plus all shipping and handling fees incurred during shipping.

 

DAMAGED ITEMS: No merchandise leaves the SIE POWER facility in questionable condition. Delivery of merchandise in good condition is the responsibility of the carrier.  It is the CUSTOMER'S responsibility to inspect the ORDER in the presence of the delivery driver. If merchandise is damaged, the driver must mark the bill as DAMAGED. If PRODUCT is discovered damaged after delivery driver has left, the CUSTOMER must call the carrier immediately for an inspection. The carrier will then contact SIE POWER so that the proper steps can be taken to file a claim. The CUSTOMER is not to return the damaged package to SIE POWER unless instructed to do so. The carrier will take the necessary steps to settle the claim. SIE POWER can not and will not replace damaged PRODUCT unless the above steps are taken and a damage claim is filed with the carrier either by CUSTOMER or by SIE POWER, depending on the carrier's instructions. If this procedure is not followed, the carrier may not honor the claim and any loss incurred will become the responsibility of the CUSTOMER.

 

RECEIPT OF ORDER: It is the CUSTOMER'S responsibility to inspect the PRODUCT immediately upon receipt and to notify SIE POWER of any shortages or discrepancies within 10 days of receipt. 

 

INSTALLATIONS

SIE POWER highly recommends professional installation by a competent mechanic for all PRODUCTS sold.  SIE POWER is not responsible for installation of any PRODUCTS sold by SIE POWER.  Any installation services offered to CUSTOMER by SIE POWER will be as an accommodation to the CUSTOMER and all expenses associated with the installation including travel and labor will be charged to the CUSTOMER and may increase taking into account any unforeseen circumstances.  All charges billed to CUSTOMER for installation by SIE POWER must be paid in full prior to CUSTOMER receiving installed PRODUCT or vehicle in which PRODUCT was installed.

 

All installations by SIE POWER will be done in a timely manner as per the schedule set forth when ordering, unless otherwise delayed due to forces beyond SIE POWER'S control. All parts removed from vehicles, will be returned to the vehicle owner unless otherwise noted or communicated.  Any part left by the vehicle owner at SIE POWER premises for over 30 (thirty) days will be considered property of SIE POWER. The CUSTOMER will indemnify and hold SIE POWER harmless from all liabilities with CUSTOMER'S vehicle, which would inhibit SIE POWER from doing the install or said work, it will be at SIE POWER'S option to get needed parts for the CUSTOMER at CUSTOMER'S expense.  SIE POWER will not be liable for any loss, damage, or theft of vehicles or articles left inside the vehicle while SIE POWER has possession of CUSTOMER'S vehicle.

 

PRIVACY POLICY

Privacy is important to SIE POWER.  SIE POWER does not ask CUSTOMERS for personal information unless truly necessary.  SIE POWER does not share personal information with anyone except to comply with the law, develop PRODUCTS, or protect their rights. 

 

WEBSITE VISITORS: Like most website operators, SIE POWER2.net collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request.  SIE POWER'S purpose in collecting non-personally identifying information is to better understand how visitors use the website.

a.   The laws of the State of Louisiana will exclusively govern any dispute between SIE POWER and CUSTOMER without reference to Louisiana's conflict of laws principles. The United Nations Convention for the International Sale of Goods shall not apply.

b.   CUSTOMER may not assign this Agreement without the prior written consent of SIE POWER.  SIE POWER or its affiliates may perform the obligations under this Agreement.  This Agreement is binding on successors and assigns.

c.   This Agreement can only be modified in writing signed by authorized representatives of both SIE POWER and CUSTOMER.

d.   SIE POWER and CUSTOMER are independent contractors and agree that this Agreement does not establish a joint venture or partnership.

e.   Statements or advice (technical or otherwise) if given without charge, are an accommodation to CUSTOMER and SIE POWER has no responsibility or liability for the content or use of such statements or advice.

f.    SIE POWER'S failure to object to any document, communication, or act of CUSTOMER will not be deemed a waiver of any of these terms and conditions.

g.   The unenforceability of any of these terms or conditions will not affect the remainder of the terms or conditions.

h.   PRODUCTS, including software or other intellectual property, are subject to any applicable rights of third parties, such as patents, copyrights and/or user licenses.

i.    CUSTOMER and SIE POWER will comply with applicable laws and regulations.

 

 

ACCEPTANCE OF TERMS AND CONDITIONS

By placing an ORDER with SIE POWER, the CUSTOMER is agreeing to these terms and conditions in their entirety.
